The Briar-Reno Fire Department faces a civil lawsuit alleging it failed to pay overtime according to requirements of the Fair Labor Standards Act and the Portalto- Portal Pay Act.
Allen Jones, a former firefighter with BRFD, has sued the department for unpaid overtime four months after his employment ended for unknown reasons. According to the original complaint, Jones seeks to represent other current and former employees of BRFD who worked overtime hours but were not paid for all overtime hours they worked in what is called a collective action suit. A collective action suit is similar to a class action suit but requires members to opt in to become part of the class.
Collective actions are often associated with employment law, especially claims under the FLSA, which governs minimum wage, overtime pay and other wage and hour issues.
